Mr. Bekir Bozdağ : Those Enforcing the Law Must Be Regulated If They Go Wrong

Mr. Bekir Bozdağ issued a statement that was effectively a summary of what Mr. Adnan Oktar has been saying for years about deficiencies in the law and said that there needs to be a regulatory system for when those who enforce the law go wrong.

ADNAN OKTAR: If a law is appropriate the judge will act in line with it. If there is a binding law, the judge can do nothing else. Laws need to be well arranged and planned. There could be judges to supervise other judges. If inspector judges are brought in, then there will be no more need for such criticism. Judges supervising other judges.; that would be very effective. An inspector to supervise judges would be a very effective thing.

ADNAN OKTAR: Every step to do with democracy is urgently needed. However, the judicial system is a big problem in Turkey. People need to be able to criticize judges. One is allowed to say almost nothing. Everything is regarded as an offense and punished accordingly because  judges  look after  judges. It is essential for this amendment to be brought in. Let us ready this as a petition and send it to the Ministry Of Justice and the Prime Ministry, and also to the European Court of Human Rights.

ADNAN OKTAR: It is very wrong that judges should be immune from legal proceedings. They are only human. They can exhibit weaknesses or make mistakes. It needs to be made easier for proceedings to be brought against judges. You cannot sue for compensation or bring other legal suits. You cannot speak out if they make a mistake. If you say they have acted wrongly that is an offense. You end up being charged with slandering the judge and you are punished. If you say, “He has not read the case file” that is an offense. One can be fined millions of lira; prison and a fine. The prime minister must concentrate on that in the Judicial Package.

ADNAN OKTAR: If the judicial system fails, Turkey will fail. If the judicial system collapses, Turkey will collapse, may Allah forbid. But we must of course be on our guard against injustice in the judicial system.

The judicial system must be strong, but there can be no saying that nobody should ever interfere in it. I have said this before, there should be judges to supervise the judicial system. There should be inspector judges. Specious cases should not be permitted but proceedings should be possible when the judge makes obvious mistakes. No proceedings can be brought at the moment, and that has to be changed.

There must be supervising judges for judges. There could be a ten member panel but there must be no bringing of proceedings for specious reasons, just to wear the judge down. The panel of judges can determine that. But the present system rejects those cases in which there is justification. For example, a blatant error is made, but no proceedings can be brought. That must be changed.

Minister of Justice Bekir Bozdağ has issued important statements about changes to be made to the legal system, and particularly in the Supreme Board of Judges and Prosecutors (HSYK).

“The HSYK is stronger than Parliament. If I make a mistake there are mechanisms that regulate ministers but if those who apply the law make an error, the law does not apply to them. The law says, “Do this.” But they do something else. If you do not intervene in that you will be encouraging those who step outside the law. The HSYK must discharge its duty independently within the judicial system, but it must also regulate those who step outside the law.”
